Workplace savings plans

Company Stock Funds are not mutual funds and are unmanaged, non-diversified investment options. The value of your investment in the Company Stock Fund is affected by the performance of the company and the overall stock market, as well as the amount and performance of any short term investments held by the fund.

Managed Income Funds, Commingled Pools and individually managed options, such as Strategies, are not mutual funds. Although individual investment contracts purchased for a managed income fund are backed by the issuer of the debt, units of the fund are not guaranteed by the manager, Plan sponsor or insured by the FDIC.

A summary of the benefits provided under a workplace savings plan is contained in the Summary Plan Description for the plan. Full details are provided in the official plan document, which governs the operation of the plan. In the event that the content of a Guaranteed Investments Limited Site or any oral representations made by any person regarding the plan conflict with or are inconsistent with the provisions of the governing plan document, the provisions of the governing plan documents are controlling.   • IF YOU LIVE IN A STATE THAT DOES NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR IF YOU ACCESS THE Guaranteed Investments Limited SITES SOLELY THROUGH AN ARRANGEMENT WITH YOUR EMPLOYER OR PLAN SPONSOR, SOME OR ALL OF THESE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.
 

Indemnification

As a condition of your use of the Guaranteed Investments Limited Sites, you agree to indemnify and hold Guaranteed Investments Limited and its Third Party Content providers harmless from and against any and all claims, losses, liability, costs and expenses (including but not limited to attorneys' fees) arising from your use of the Guaranteed Investments Limited Sites, or from your violation of these Terms. This provision may not apply to participants in certain employer-sponsored workplace savings plans.

 

Changes to Guaranteed Investments Limited sites

Unless otherwise agreed, Guaranteed Investments Limited may discontinue or modify the Guaranteed Investments Limited Sites at any time without prior notice to you, and you accept those modifications if you continue to use the Guaranteed Investments Limited Sites.

 

Termination

Guaranteed Investments Limited may terminate your access to the Guaranteed Investments Limited Sites for any reason, without prior notice.

 

Governing law

Unless otherwise agreed, these Terms and their enforcement are governed by the laws of the Commonwealth of Massachusetts, without regard to conflicts of law, and shall inure to the benefit of Guaranteed Investments Limited's successors and assigns, whether by merger, consolidation, or otherwise. This provision may not apply to participants in certain employer-sponsored workplace savings plans.

 

Severability

If a court of competent jurisdiction deems any provision unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
